Our experience has shown that many of our clients have the same initial questions regarding nursing home neglect cases. Our goal with this article is to help answer some of those “Frequently Asked Questions” for you.
What needs to be shown in order to recover monetary damages in a nursing home neglect/elder abuse claim
- A duty of care owed by the nursing home to the patient
- The specific standard of care that should have been followed by the nursing home
- The specific care and treatment that occurred and a failure of the nursing home to follow the standard of care required
- The patient suffers death or injury as a result of the nursing home breaching its duty of care to the patient
How do I find out if my loved has a case?
A careful examination of the facts is required to determine if there is a case. The attorneys at the Law Offices of Samuel Fishman are here to meet with and discuss your case. Our office will provide you with a FREE consultation under which we will discuss all of the facts of your case.
If I do have a case, how much do you charge?
Our office has a guarantee under which you will not pay a single fee until we recover money for you. Our fee is “contingent” upon the recovery of money for your case. This means that unless and until we recover money for you, there will be no fees charged.
How long do I have to file a case?
Generally, the Commonwealth of Pennsylvania and the State of New Jersey each impose a two year statute of limitations on nursing home neglect cases. This means that if you do not file your case within two years, you will be forever barred from recovering any monetary damages. This is why time is of the essence in pursuing nursing home neglect/elder abuse cases.
What can I do if I suspect that my loved one is being abused or neglected?
There are several things that you can do. First, you can bring the neglect to the attention of supervisors at the nursing home. You should also document any and all neglect and abuse that you believe is occurring. This includes taking pictures, recording names of staff that you have encountered, recording the details of the neglect or abuse, obtaining the names and contact information of other people who may have witnessed the neglect or abuse, and paying close attention to what your loved one is telling you.
If you believe that neglect has harmed or is currently harming you loved one, then you should ccontact our office immediately. We will promptly schedule a FREE consultation to discuss the facts of your case. At this meeting, we will ask that you bring all of the information that you have regarding the suspected abuse or neglect so that we can make a proper analysis. After this meeting, we will inform you as to how we can help you and your family member regarding the abuse that they have suffered.
